USER-GENERATED CONTENT POLICY

This User-Generated Content Policy (“Policy”) governs any content submitted, posted, uploaded, published, or otherwise shared by users (“User Content”) on www.tamsenhorton.com, within Company programs or communities, or through any related digital platforms operated by Vacationing Life LLC (“Company,” “we,” “our,” or “us”). By submitting or posting User Content, you agree to the terms of this Policy.

This Policy applies to all locations where User Content may appear, including but not limited to: communities, comments, forums, social groups, messaging areas, coaching calls, Q&A submissions, uploaded files, audio, video, images, testimonials, reviews, and AI-generated content submitted by users.


 

1. TYPES OF USER CONTENT ALLOWED

Users may be allowed to submit the following categories of content (as selected by the Company):
Comments, -Posts, Images, Videos, Audio, Testimonials, Reviews, Uploaded files

Examples may include:

  • posts in community areas
  • comments or questions
  • uploaded documents or templates
  • screenshots or progress updates
  • testimonials or reviews
  • AI-generated output the user chooses to share

All User Content must comply with this Policy, the Company’s Terms of Use, Community Guidelines, and all applicable laws.


 

2. PROHIBITED USER CONTENT

You shall NOT upload, post, or share content that:

(A) Violates the law

Including but not limited to content that is defamatory, fraudulent, misleading, deceptive, impersonating, harassing, or discriminatory.

(B) Contains intellectual property you do not own

Such as:

  • copyrighted documents
  • paid course materials
  • proprietary graphics
  • private emails or messages
  • content from other creators, unless you have express permission

(C) Contains sensitive personal data

Including private information about yourself or others, such as:

  • home address
  • financial information
  • legal matters
  • health data
  • passwords
  • confidential business information

(D) Contains AI-generated harmful or misleading content

Such as:

  • fabricated testimonials
  • deepfakes
  • false claims about income, health, or results
  • AI-generated impersonations

(E) Violates platform rules or community etiquette

Including:

  • spam
  • sales pitches
  • scraping or data harvesting
  • aggressive or hostile behavior

The Company reserves the right to remove prohibited content at any time without notice.


 

3. COMPANY’S RIGHT TO MODERATE, REMOVE, OR RESTRICT USER CONTENT

The Company may moderate User Content in the following ways:

  • Prior moderation: No
  • After posting: Company may remove or restrict content at any time
  • Automatic moderation: AI tools may flag or classify content for review
  • Content review upon complaint
  • Termination: Users who violate this Policy may lose access

The Company is not obligated to review or monitor User Content, but may do so at its sole discretion to maintain a healthy environment.


 

4. LICENSE YOU GRANT TO THE COMPANY

By posting or submitting User Content, you grant the Company a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to:

  • use
  • reproduce
  • distribute
  • edit
  • modify
  • publish
  • translate
  • display
  • create derivative works
  • incorporate into Company products, marketing, or materials

License Terms Selected:
 Non-exclusive license, Worldwide use, Royalty-free, Perpetual, Irrevocable, Editable for clarity

This includes the right to use User Content in:

  • private or public communities
  • marketing materials
  • product updates
  • educational content
  • social media
  • case studies

If you do not wish for User Content to be used in these ways, you should refrain from posting content.


 

5. AI-GENERATED USER CONTENT

If you submit content created in whole or in part by artificial intelligence:

  • You represent that you have the legal right to submit it.
  • You must disclose material use of AI if the content appears human-authored.
  • You may not submit AI-generated deepfakes, impersonations, fabricated claims, or misleading content.
  • You grant the Company the same rights to AI-generated content as any other User Content (Section 4).

The Company may use AI tools to analyze, classify, summarize, or assist in reviewing User Content.


 

6. NO EXPECTATION OF CONFIDENTIALITY

Any content, comments, materials, questions, or information you submit or post including but not limited to within the Company’s communities, coaching calls, group programs, messaging channels, forums, or similar spaces (“User Content”) is not private and is not confidential.

These spaces are designed for shared learning and community interaction. As such, User Content may be visible to the Company, its team, and other participants who have access to the applicable area.

By posting or participating, you acknowledge and agree that you have no expectation of privacy, confidentiality, or privilege regarding any User Content you choose to share.

You are solely responsible for the information you disclose. Do not post, share, or upload any confidential, sensitive, or proprietary information—including but not limited to personal data, financial details, trade secrets, client information, or materials subject to nondisclosure obligations.


 

7. USER’S RIGHTS TO DELETE OR EDIT CONTENT

Your rights, regarding your posted content:
User deletion settings: Yes

Even if you delete content, copies may remain:

  • in backups
  • in cached systems
  • in other users' replies or shared documents
  • if the Company has already relied on the content (e.g., case studies, reviews)

The Company is not obligated to remove historical references or derivative works.


 

8. INTELLECTUAL PROPERTY OWNERSHIP OF USER CONTENT

You retain ownership of your User Content, subject to the license granted above.

You represent and warrant that:

  • you own the content,
  • you have the right to grant the license,
  • posting the content does not violate any third-party rights.

If a complaint arises regarding IP, privacy, or defamation, the Company may remove content and/or take corrective action.


 

9. REPORTING VIOLATIONS OR PROBLEMS

If you believe that User Content violates this Policy, includes copyright infringement, or involves harmful or illegal behavior, report it to:

Reports may be reviewed manually or by AI moderation tools.


 

10. COMPANY’S RIGHTS UPON VIOLATION

If you violate this Policy, the Company may:

  • remove your content
  • limit or block access
  • terminate community membership
  • revoke product access
  • restrict future participation
  • cooperate with legal authorities if required

Consequences may also follow: Violation of any rules, guidelines, and or policies


 

11. FORCE MAJEURE AND TECHNOLOGY OUTAGES

The Company relies on third-party platforms and technology providers, including but not limited to email delivery systems, payment processors, hosting platforms, automation tools, and AI providers. The Company shall not be responsible for any delay, disruption, data loss, or failure in performance resulting from:

 

• outages or downtime on hosting platforms;  

• failures or delays in email or communication systems;  

• API or integration breakdowns;  

• platform migrations or unexpected software changes;  

• AI provider outages, hallucinations, or processing errors;  

• cyberattacks or security incidents affecting third-party vendors.

 

The Company will make reasonable efforts to restore access or provide alternatives; however, such disruptions do not entitle the User to refunds, extensions, or damages.

 

 

12. MODIFICATIONS TO THIS POLICY

The Company may update or revise this Policy at any time. Updates take effect immediately upon posting.
